Terms and conditions of renting the apartments from APARTEL Sp. z o. o.
§1. Definitions
- Client – a natural person or legal entity making a reservation who is a party to the rental contract. If payment is made online, entity making the payment for the reservation is considered to be a client, party of contract.
- Lessor – APARTEL Sp. z o. o. based in Warsaw at ul. Flory 1/16, NIP: 701-043-35-72, REGON: 147331102, KRS: 0000515592, tel. 572-021-923 email: pawel.dudek@apartel.waw.pl.
- Apartment – separate housing unit, subject of the lease agreement, presented in the offer of APARTEL Sp. z o. o.
- Guest – each person staying in the apartment reported during the booking.
- OTA – an external reservation system that mediates in the booking process and / or the conclusion of a rental agreement.
- Stay – a specified number of days for which a rental contract for apartment has been concluded.
§2. Subject of the Regulations
- This document regulates the rules of booking and using the apartments offered by the Lessor and is an integral part of the lease agreement.
- These regulations can be accessed online on the website apartel.waw.pl/en/terms-conditions . It is also sent as an attachment to the email confirming the reservation.
- In addition, an excerpt from this document stating the rules for the use of the apartment (the entire point 4 of this document) is displayed inside each apartment.
- Booking the apartment by the Booker is tantamount to reading this document and their acceptance and conclusion of the Lease Agreement between the Client and the Lessor.
- Before booking, Client is responsible for reading the apartment description and the terms and conditions. The description of the apartment is an integral part of the lease contract.
- If the booking is made through an OTA, additionally OTA’s regulations become part of the contract.
§3. Booking and Payment Terms
- Client is obliged to provide following true and accurate information:
- Full Name
- Contact information
- Telephone number
- Email address
- Number of people staying in the apartment
- Check-in and check-out dates
- If client is a legal entity, additionally:
- Official business name
- Tax Number
- After booking, the confirmation email will be sent to client’s e-mail address with the individual reservation number, reservation details and copy of these regulations. The client’s duty is to check the correctness of the booking details and read the regulations.
- The reservation fee can be paid in the following ways:
- By bank transfer
- By cash or by payment card at the company’s headquarters at ul. Flory 1/16 in Warsaw from 9 am to 4 pm on weekdays.
- By means of a payment card using the MOTO service.
- With the help of embedded payment systems on OTA’s website.
- By using the payment system on the website www.apartel.waw.pl
- In the case of cancellation, the reservation fee paid is not refundable.
- In the case of making a reservation with the use of OTA, the client is bound by the regulations and the cancellation terms applicable to this system.
- Unless specified otherwise. For reservations made by phone, e-mail or using the www.apartel.waw.pl website. the following cancellation policies apply:
- in the event of cancellation of the reservation more than 14 days before the date of arrival, APARTEL Sp. z o. o. will refund 90% of the fee,
- in the event of cancellation less than 7 days before the date of arrival, APARTEL Sp. z o. o. will refund 40% of the fee,
- in the event of cancellation of a reservation less than 24 hours before the check-in time, the guest is not entitled to a refund,
- shortening your stay does not entitle you to reimbursement.
- Until the last day of the stay, the fee is treated as a reservation fee. The tax obligation arises when the service is rendered, that is on the last day of booking. If the Buyer wants to get an invoice, the VAT representative should inform the landlord before the end of the stay, otherwise a receipt will be issued.
§4. The rules of using the apartment
- Check-in time starts at 15:00.
- Check-out time starts at 10:00.
- Late check-out or early check-in is possible but subject to availability and advance notification. In disputable situations, the order of applications decides.
- In the case of not leaving the apartment until 10:00 or other individually determined, employee of APARTEL Sp. z o. o. or its contractor’s has the right to enter the apartment and start cleaning and to take away the belongings of the guest from the apartment. The guest may be charged with the costs of moving and storing his belongings.
- Every change of check-out and / or check-in time should be confirmed by SMS or e-mail. If client does not receive such confirmation, it should request it.
- Check-in and check-out take place remotely, information on how to check in is sent to the email address and/or phone number provided when booking. In the absence of access to the above, the reservation information can be provided only upon presentation of an identity card or its scan.
- The condition for receiving the information about the check-in process is payment of the entire amount of the booking.
- It is forbidden to use open fire inside the apartments and buildings where they are located, it is also forbidden to use such items as: candles, lighters, matches, tourist ovens, cigarettes, etc. The client is liable for the damage resulting from the use of the above-mentioned objects; additionally, it is punishable by up to 500 PLN.
- Organising parties and events that can disturb domestic peace of other inhabitants of the building is prohibited, especially hen and stag parties. In case of police intervention or damages to the apartment, building or other property reservation will be cancelled immediately client can be additionally charged with additional charge of 500PLN.
- Quiet hours are from 22:00 to 6:00.
- It is prohibited for unregistered visitors to be inside of the apartment between 23-6.
- Client will be charged 100PLN for each unregistered visitor staying between 23-6.
- It is forbidden to keep animals in the apartment, unless agreed differently.
- Client is liable for all of their guests and the damage caused by them. In case of damage Lessor will seek compensation directly from the Client.
- Client is obliged to immediately report any damage to the apartment and its equipment.
- Children under the age of 13 should stay in the apartment under adult supervision. The landlord is not responsible for the life and health of children staying in the apartments.
- In the event of Force Majeure, the landlord reserves the right to change the apartment to another one of the same or higher standard in the area for the same price.
- Client is responsible for the security of the apartment, in particular, closing the entrance door and windows, not sharing the entrance instructions and codes with unauthorised persons. Please take care of the rented apartment and the environment by turning of the lights and water when unused.
- For stays longer than 2 days, guests are required to take out rubbish. Keys and instructions for taking out trash can be found on the inside of the cabinet door under the sink.
- The apartment is an independent apartment used by the client based on the lease agreement. Therefore, the Lessor is not responsible for the loss or damage of the items brought by the client and guests. In particular, he does not bear the liability referred to in art. 846-852 of the Polish Civil Code.
- In case of using additional paid channels and VOD service, the client will be charged a fee adequate to the services used.
§5. Complaints
- Client has a right to file a complaint if he feels he was misled about the kind or standard of the service.
- Right to the complaint is only valid during the stay.
- Complaints can be reported by the telephone or email to the lessor.
- Complaints must be supported by evidence such as photos, print screens and/or testimonies.
- The decision on recognizing or rejecting a complaint must be justified in writing and is final.
§6. Personal data protection
- The Lessor is the administrator of personal data, applies technical and organizational security in order to ensure their safety. Data collected by the lessor is used only for the services and marketing purposes of the company. The data is not and will never be shared with any other organization, except for a court order or consent of the data owner.
- The Client submits his personal and guest data voluntarily and gives consent to their processing and placement in the database, for purposes directly related to the delivery of the ordered service and for marketing purposes; in accordance with the Act of 29.08.1997. about personal data protection.
- Client has the right to information about his personal data being stored and processed by the lessor and their removal. For this purpose, you should contact the landlord by e-mail or telephone and confirm your identity by means of an identity document scan.
§7. Additional provisions
- In matters of dispute, Polish law is applicable.
- In the event of any damage resulting from poor use of the apartment, the holder will be charged for renovation costs and loss of earnings in the amount of PLN 300.00 for each day that the apartment cannot be used.
- The Lessor is not liable for any inconvenience caused during the stay related to construction works, noise, interruptions in water and electricity supply that are outside of its control.
